These Website Terms of Use govern your access to and use of the Servicebird™ website, operated by Servicebird Ltd (Company Registration Number: 17420098, registered in England & Wales, ICO Registration Number: CSN8127056). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
3.1 Who these Terms apply to
The Services are intended for use by public sector “Requester” organisations seeking to source professionals, and by vetted independent “Freelancer” professionals offering services through the platform. General visitors browsing the Site are also bound by the general website-use provisions below.
3.4 Acceptable use
You must not use the Services to:
- Break any applicable law or regulation, including data protection, safeguarding, and procurement law;
- Upload or transmit any material that is unlawful, defamatory, or infringes a third party’s rights;
- Attempt to gain unauthorised access to the Site, other users’ accounts, or our systems;
- Circumvent the platform to transact directly with a matched party in a manner that avoids agreed platform fees, where a fee agreement is in place.
3.5 Intellectual property
All content on the Site — including the Servicebird name, logo, “Connect. Comply. Deliver.” tagline, design, text, graphics, and underlying software — is owned by or licensed to Servicebird and protected by copyright, trade mark, and other intellectual property laws. You may not copy, reproduce, or exploit any part of the Site without our prior written consent, save for temporary caching necessary for normal browsing.
3.7 Disclaimers and liability
The Services are provided on an “as is” and “as available” basis. While we take reasonable care in vetting Freelancer professionals, Servicebird does not guarantee the availability, conduct, or quality of any service ultimately delivered by a Freelancer, and Requester organisations remain responsible for satisfying themselves as to a Freelancer’s suitability for a specific assignment, including any statutory safeguarding checks required for that engagement.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded. Subject to that, to the maximum extent permitted by law, Servicebird’s total liability arising out of or in connection with the Services is limited to the fees paid to Servicebird in the 12 months preceding the claim.
3.9 Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, save that public sector Requester organisations may have separate contractual dispute resolution provisions under their procurement framework agreements.
3.10 Changes to these Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
